Terms of Use – FlexiCard App

These Terms of Use (the "Terms") apply to the FlexiCard mobile application (the "App"), created by Lubomír Merta (the "Service Provider") as a free service.
By downloading or using the App, you agree to these Terms. We strongly recommend that you read them carefully before using the App.
Intellectual Property
Unauthorized copying or modification of the App, or any part of it, is strictly prohibited. Attempts to extract the App's source code, translate the App into other languages, or create derivative works are likewise not permitted. All trademarks, copyrights, and other intellectual property rights related to the App itself remain the property of the Service Provider.
Third-Party Logos and Trademarks
A store logo can be assigned to a card in the App in two ways: by selecting one from the App's built-in library of common store and brand logos, provided to make it easier to identify a card, or by using a custom image that the user chooses themselves — selected from the device's photo gallery, downloaded from a specified URL, or taken with the camera.
Logos from the built-in library are used solely to identify the relevant stores, are displayed in their original, unaltered form, and remain the exclusive property of their respective owners. Their use does not in any way imply partnership, sponsorship, affiliation, or endorsement by the relevant brand of the developer or operator of the App. If a trademark owner does not wish their logo to continue appearing in the built-in library, they may contact us at legal@flexicard.app, and the logo will be removed without undue delay via an app update.
If a user chooses a custom logo image instead, they select and upload it themselves — neither the App nor the Service Provider selects, approves, or has access to such content beyond the user's own device or storage. It serves solely to identify that card within the user's private card list. You, as the user, are responsible for any content you upload this way and for ensuring that your use of it complies with the rights of third parties.
Your Data
Neither the App nor the Service Provider collects or stores your personal data on any server of its own. All data you enter into the App — cards and their codes, photos of the front and back of a card, chosen logos, and notes — is stored locally on your device.
You may optionally create a backup of this data: locally, or automatically after signing in to Google Drive (available on both Android and iOS) or iCloud (Apple devices only), or to another storage location connected as a file system on your device (e.g., your own NAS, Dropbox, or another cloud service). All backups, whether local or cloud-based, are encrypted (PBKDF2 and AES-GCM) with a password you choose yourself, which must be at least 12 characters long. The Service Provider does not know this password and therefore has no access to the contents of any backup.

Device Security
You are responsible for the security of your phone and access to the App. The App optionally allows you to lock access using biometric authentication (e.g., fingerprint or Face ID) or a PIN code; we recommend enabling this feature, especially if you share your device with others. The Service Provider strongly advises against jailbreaking or rooting your device — i.e., removing the software restrictions imposed by the device's operating system manufacturer. Doing so may expose your device to malware and security risks and may cause the App to malfunction or fail entirely.
Internet Connection
The App works primarily offline; an internet connection is needed only for optional features — backing up data to the cloud and downloading a custom card logo from a specified URL. For these and any future features requiring a connection, this may be either Wi-Fi or a connection provided by your mobile carrier. The Service Provider is not responsible if the App fails to perform at full capacity due to unavailable Wi-Fi or your having used up your data allowance.
If you use the App outside the range of Wi-Fi, the terms of your mobile carrier's contract continue to apply — you may therefore be charged data usage fees, including roaming charges, if you use the App outside your home territory without disabling data roaming. By using the App, you accept responsibility for any such charges. If you are not the bill payer for the device on which you use the App, you are assumed to have obtained the bill payer's permission.
User Responsibility
The Service Provider cannot accept responsibility for how you use the App. Because all card data is stored exclusively locally on your device (see the Your Data section), it is your responsibility in particular to:
- take care of your device's security, for example by setting a screen lock and using the App's biometric or PIN lock,
- create your own backup of your data — whether to Google Drive, iCloud, your own NAS, or any other storage accessible from your device — if you want to ensure you don't lose your saved cards in the event your device is lost, damaged, stolen, or replaced; without an active backup, the Service Provider retains no copy of your data and cannot recover it if your device is lost,
- keep safe the password used to encrypt your backup — without it, the backup cannot be restored or decrypted, even by the Service Provider, who does not know it and has no access to it,
- ensure the accuracy and currency of the data you enter into the App yourself.
Updates and Termination of Service
The Service Provider may modify the App at any time and for any reason, including in response to requirements of the operating system on which the App runs. Continued use of the App may therefore require you to download an update; you agree to accept updates whenever they are offered to you. The Service Provider may discontinue providing the App at any time without prior notice. Unless stated otherwise, upon termination, all rights and licenses granted to you under these Terms will end, and you must stop using the App and, if necessary, remove it from your device.
Changes to These Terms
The Service Provider may update these Terms from time to time. We recommend checking this page periodically for any changes. You will be notified of any changes by the publication of a new version of the Terms.
